State Could Step Up

Despite an official California policy in place since 1992 that calls for “no net loss” of wetlands, the lack of a specific wetlands definition has led to the loss of many thousands of acres of ecologically important lands. That could change soon, thanks to an update from the State Water Resources Control Board expected out soon after more than a decade of work. California environmentalists are optimistic that the updated policy, titled “State Wetland Definition and Procedures for Discharges of Dredged or Fill Material to Waters of the State,” will move quickly toward adoption by the state board in early 2019.

The Nature Conservancy’s venture in growing food crops for wintering cranes on Staten Island is under fire from an unexpected source—the Wetlands Preservation Foundation.

The nonprofit, headed by Stockton tomato packer Dino Cortopassi, is suing TNC and the California Department of Water Resources, which holds a conservation easement on Staten Island, alleging farming practices that cause soil subsidence and threaten levee integrity, and misuse of revenue from farm operations. The 9200-acre farm, acquired by TNC in 2001, is a major destination for migratory greater and lesser sandhill cranes (the latter a California endangered species) as well as Aleutian cackling geese and other birds. As habitat is replaced by houses, orchards, and vineyards, a third of the state’s crane population converges on the island to feed in corn and triticale fields and roost at night. Restoring wetlands is an extremely effective way to cool land surfaces, a study conducted in the Sacramento-San Joaquin Delta indicates.

For three years, Kyle Hemes of UC Berkeley and colleagues kept tabs on the heat flux and air flow above three restored Delta wetlands on Twitchell and Sherman islands, and an alfalfa field on Twitchell Island. Surface temperatures at wetlands with open water were up to 5.1 degrees Celsius cooler than the crop field during the daytime. As expected, the dark open water absorbed more solar radiation, and released the energy slowly at night. But wetland vegetation played a role as well. Just months after becoming the first project awarded Measure AA funding, the first phase of tidal breaching at the Montezuma Wetlands restoration project will be two-thirds complete by the end of November.

“We are on track to complete the levees and transition zones next year so we can breach into the slough and restore the area to tidal action,” says Jim Levine, managing partner of Montezuma Wetlands LLC, which owns the property. The breach of the first major restoration area is planned for December 2019. This phase of the multi-phase project will restore 600 acres of previously subsided shoreline on the eastern edge of Suisun Bay to tidal, seasonal and some sub-tidal habitat. “A lot of threatened and endangered species habitat is going to be provided just by Phase One of this really large effort,” says the Coastal Conservancy’s Laura Cholodenko. Big Restoration Experiment for the Delta’s Dutch Slough

Development agreements were already in place for three parcels of land around Dutch Slough when John Cain first took a hike in this West Delta area in the spring of 1999. “It was clear as day to me that removing the levee would be a great way to restore freshwater wetlands at the mouth of Marsh Creek,” says Cain. Almost two decades later, earthmoving equipment is now preparing 1,178 acres for conversion to marsh habitat.

California’s Wild and Scenic Rivers System expanded for the first time in 13 years in June when Governor Edmund G. Brown Jr. signed legislation protecting 37 miles of the upper Mokelumne River.

It was the culmination of a long struggle for the Jackson-based Foothill Conservancy and other river advocates. Four years ago, a Mokelumne bill was approved by the state Senate but killed by a parliamentary maneuver  that blocked a vote in the Assembly. Despite significant support in Calaveras and Amador counties, the bill was opposed by local water agencies concerned about the potential impact on their water rights. In 2015 Assemblyman Frank Bigelow (R-O’Neals) successfully proposed a state study of the Mokelumne’s suitability for wild and scenic designation. A levee replacement project near the small town of Hamilton City is breaking ground as the first project that the US Army Corps of Engineers has approved based in part on potential benefits to an ecosystem. “We’ve been told this will be a national model once it’s completed,” says Lee Ann Grigsby of Hamilton City. The levee, whose original construction failed to meet modern standards, had needed to be fixed for a long time: recent estimates gave it only a 66% of withstanding a 10-year flood scenario. “Small sensors are the foundation of big science,” says Phil Trowbridge, director of the Bay’s Regional Monitoring Program which has just released a new synthesis report on sediment science. Eighteen years after local stakeholders adopted the Putah Creek Accord to guarantee minimum flows and other enhancements, birdlife is flourishing in the Creek’s Riparian Reserve, highlighting the restoration of what was once a dried-up ditch.

Former U.C. Davis post-doc Kristen Dybala and her colleagues recently reported in Ecological Restoration on a project that monitored populations of breeding species, mostly songbirds, at the Reserve and 13 other sites along lower Putah Creek from 1999 through 2012. Some sites had seen active restoration efforts to benefit native fish; others had not. Overall, birds seemed to respond to the modified flow regime, with positive trends for 27 species and greater community diversity. Napa County voters will weigh in on the fate of the county’s remaining oak woodlands this June, when they cast ballots on Measure C, the Watershed and Oak Woodland Protection Initiative.

“Ninety-five percent of oaks on the valley floor are gone and we want to do a better job reducing deforestation on the hills” initiative co-author Jim Wilson, told the Bay Area Monitor. “Our hillsides are beautiful and also filter rain, keeping water clean as it replenishes aquifers.” Most of Napa’s oak woodland loss is due to vineyard development, and the county General Plan projects that another 3,000 acres of woodland will be converted to vineyard by 2030. Not the Last Word on Buckler

In January, the Bay Conservation and Development Commission and the San Francisco Bay Regional Water Quality Control Board appealed December decisions by a Solano Superior Court Judge concerning Point Buckler and its owner John Sweeney. The decisions voided $3.6 million in fines and cleanup and restoration requirements that the two agencies had imposed on Sweeney for dumping and excavation in Suisun Bay, and draining tidal wetland, without authorization. “If this decision sets precedent, we’re in real trouble,” says Erica Maharg of San Francisco Baykeeper. “It would mean that our agencies don’t have the authority to protect these ecosystems.”
